DISCLAIMER: National Crime Search recommends you conduct due diligence with respect to Fair Chance Hiring laws and ordinances (aka “Ban the Box”) that may be applicable to your organization at the state, county or local level. As of January 2018 Ban the Box ordinances are applicable to private employers in Connecticut, Hawaii, Illinois, Massachusetts, Minnesota, New Jersey, Oregon, Rhode Island and Vermont, as well as in major cities including (but not limited to) Austin, Los Angeles, New York City, Philadelphia, San Francisco, Seattle and Washington, D.C. These laws may require employers remove the criminal history question from job applications, consider criminal history information later in the hiring process, and take additional steps when using criminal history information such as conducting an individualized assessment or advising job applicants about the reason(s) for denial if based on criminal history information. Compliance with these requirements is in addition to an organization’s compliance with the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.).
